Hasbro sues Asus in Transformer war

Hasbro thinks Asus is guilty of appropriation of Transformers' names, in one of the more bizarre litigation cases seen this year.

Toy maker Hasbro has reportedly kicked off legal proceedings with Asus over the use of the Transformer Prime name, in one of the stranger litigation cases of 2011.

Hasbro owns certain trademarks of the Transformers franchise, which many will know from the classic cartoons of the 90s or the poorly-rated Michael Bay films.

Many will also remember how the leader of the Autobots – the good guys who fought the evil Decepticons – was called Optimus Prime.

Hasbro has taken umbrage with what it believes is appropriation of the name for the Eee Pad Transformer Prime tablet.

"The specific actions we are taking today against Asus underscores yet again Hasbro’s willingness to pursue companies who misappropriate our intellectual property for their own financial gain," a spokesperson said.

The Android-based Eee Pad Transformer Prime has been receiving some fairly positive reviews, so Asus will be hoping nothing will upset its progress.

The tablet market is still dominated by iPad, with Android-based devices still floundering when compared to Apple's massive sales.

The original Eee Pad Transformer was given a positive review from IT Pro in May, when it received five stars out of the maximum six.

I for one am starting to get sick of all these BS lawsuits.
At least there's no Asus "My little pony" or "Mr. Potato head."

couldn't agree more stop tying up courts resources in a bid to try and get some free money

i understand protecting IP but come on if your R&D and devs can come up with a technology then surely so can mine

I think these law suits are getting ridiculous. No one owns a word, so therefore its a crap lawsuits.No one can say that no one else in the world can come up with the same or a similar method to do something and not know someone else thought of it too.
It`s about time the courts here put a stop to it once and for all.
Though there might be a case here and there thats a blatant patent rip off.

well, so long as Asus didn't steal the same mechanics used for transforming in the Hasbro products, i think they should be fine. Right? :-P

Some of you are missing the point. A trademark is a picture, letters or WORD/S. that is a legal fact and protects someone else from profiting from your idea.

Whether a trademark applied to a game should also prevent someone using it for an unrelated market is open for discussion, however it probably hinges on the classes that Hasbro applied for in their trademark.

You can scream all you like about bs, however trademarks are an essential part of business law. Wishing it were not so does not change the legal realityor Hasbro's right to sue if they were awarded the trademark for that class of products.

why, ASUS haven't called the transformer the optimus prime its just the transformer prime!

thinking of that didnt even make me think of the movie game toy franchise and thats there defence they will loose money because people go buy a ASUS transformer prime instead of an Optimus Prime

pretty childish if you ask me

I'm with amcmo on this one. I'm sure Asus would be just as pissed if someone else used their trademark... They were trying them out with "transformer" and really pushing the line with "transformer prime".
My bet is that the toymaker will either win in court or reach a settlement for a nice sum of money, all depending on their lawyers of course.

You will probably find that Hasbro have Trademarked Transformer, Transformer Prime etc.

Trademark is simple (and complex) however, you use someone's trademark, or variant of at your peril.

The test isn't whether you think of the game,simply whether it's use breaches trademark law

I think Hasbro has the trademark on "Transformers" not Transformer. I think they also have a trademark on "Transformers Prime" as well. Sounds like they do have a case, but what do I know about this stuff.
