Apple secures patent victory over HTC

iPhone maker not infringing S3 Graphics patents.

Apple has won a victory against HTC in its ongoing patent battle.

The dispute related to patents held by S3 Graphics, which was recently bought by HTC - mainly for its portfolio of the patents that are an increasingly sought after currency in the tech industry.

But the US International Trade Commission dismissed accusations that Apple had used the S3 technology in its handsets, casting doubt over the wisdom of the acquisition by HTC.

The commission reversed an earlier preliminary ruling that some Apple products had violated S3 patents involving texture compression used in applications such as 3D games.

The panel said it was terminating the investigation because it found "no violation".

The ruling echoed an earlier patent victory for Apple over HTC. Apple is also involved in patent disputes with Samsung.

HTC with serious egg on face and now conduction a 'holistic review' of the whole purchase of S3.

Seems they raced out to buy S3 with the sole aim of blocking iPhone sales.

Now they've lost the suit, they want to cancel the buy?

AMD tried to step in on Apple's side claiming they in fact owned the patent's in question and licensed Apple to use them. While they were not allowed to give evidence in the case, the ITC came down firmly on Apple's side in this.

Now HTC want their money back?

Guess they'll need it as they've lowered their forecast for next year first to 30% growth and now to almost zero.
