iPhone 4S to be banned in Australia?

Samsung has hit back at Apple with an iPhone 4S lawsuit.

Samsung today followed through on its threats to try and block the iPhone 4S in Australia, which it has accused of patent violations in relation to mobile broadband technology. Similar injunctions have also been issued in Japan, Paris and Milan

The Korean conglomerate filed a preliminary injunction motion against the iPhone 4S in a NSW court today. Samsung has accused Apple of infringing on three of its patents in Australia. The iPhone 4 and Apple iPad 2 are also targeted in the Japan filing.

The patents in dispute are as follows:

  • Method and apparatus for transmitting/receiving packet data using pre-defined length indicator in a mobile communication system (WCDMA)
  • Method and apparatus for data transmission in a mobile telecommunication system supporting enhanced uplink service (HSPA)
  • Method and apparatus for transmitting and receiving data with high reliability in a mobile communication system supporting packet data transmission (HSPA).
  • The new preliminary injunction motion follows Apple's legal victory last week, in which a Sydney court barred the Samsung Galaxy 10.1 from sale in Australia until a patent dispute between the tablet makers could be resolved. 

    After last week's court decision in favour of Apple, a Samsung spokesperson vowed that the company would fight back.

    "Samsung will continue its legal proceeding against Apple‘s claim in order to ensure our innovative products remain available to consumers," Samsung stated. "We will continue to legally assert our intellectual property rights against those who violate Samsung’s patents and free ride on our technology."

    It will be interesting to see how the court responds to the motion – if Samsung succeeds in barring the iPhone 4S from sale, it is sure to make headlines around the world. We'll keep you posted with updates as we get them.
